I wonder if Oher is broke, and something that didn't bother him while he was an NFL LT bothers him now that he see's all that money he 'missed' out on.

It's unfortunate as a whole. Does he deserve to be compensated for his 'story'? Sure. Did he also remove any legal ground to stand on? It appears that way... It's all sad.
Him being under a conservatorship, and still being under one, is very real.

Meaning they can continue to raid his bank accounts and the like even unto the present day, and theoretically use his money to pay for the Tuohy's legal costs(did actually happen in the Britney Spears situation). Oher cannot stop them from doing so because he's a legal vegetable; as long as say them using his funds is for his "care", they can use his money.

There is no familial tie establish legally with a conservatorship, it's a glorified permanent babysitting arrangement in which the babysitter has complete control indefinitely over his "ward", or should I say dog because the ward basically cannot get out of it until his babysitter says he can, and the babysitter can refuse to do so forever.

As he is not adopted, he does get any legal privileges a "real son" gets, including inheritance.

Adult Adoption in Tennessee is actually cheaper and less hassle when adopting an adult over a child.

Most pleadings will contain some paragraphs that may stretch the truth or be unprovable. Other paragraphs, contain sentences that are impossible to deny as truth. Oher is in a conservatorship(guardianship in other locales). Oher is not legally adopted.

It is is their inactions that lend some credibility that financial misconduct has occurred. There are legal requirements to file accounting documents to the courts but the file is completely empty.

Even without actual damages(doubtful), the complaint filed is one to terminate the conservatorship. That's it's title, and that is the action Oher wants the court to do.

As it stands, the Tuohys can just simply present the court order to any bank and the bank would give them access to the money he has.

And it's clear he was never adopted, because a guardianship isn't adoption. The conservatorship/guardianship turns the individual into the equivalent of a vegetable and a dog. As someone unfit to care for oneself, the testimony of the unfit will not be regarded as evidence to terminate the conservatorship. Like a dog, the owner can choose how well or poorly to treat it and that control of the animal never truly escapes the "owner" until the owner consents.

The Order granting the conservatorship is real and thus what is fact is that Oher is not part of the Tuohy family nor has any of the legal entitlements a proper son has. In addition, unlike adult children, the Tuohys can still access his bank accounts or stores of wealth/money, deny him the ability enter into a contract without the Tuohys approval(so even his NFL contracts still required a yes from the Tuohys, unlike practically every other football player), controls his medical decisions,

So, is your stance the conservatorship must continue?

The youtube video presents a copy of the actual court order granting conservatorship and a copy of the petition to terminate the conservatorship. You not wanting to accept a document in the public record is merely intellectual dishonesty. Because you are denying what the courts did give to the Tuohys. Merely because a Youtuber is repeating what is said in the paper does not invalidate the Court Order's contents.

What is pathetic about your response is that if you were given a pdf of the same files(the petition is in at least on media article), you would read, or maybe not, given your conduct shown already. You deny the existence of the court order, and therefore deny there is a conservatorship.



The Tuohys are conservators of both his person and his finances. Thus, unlike the usual adult, his bank accounts where he put his football money are also free to access and monitor by the Tuohys.
 
Guys... no one knows (yet) what exactly transpired in this specific scenario, not only in terms of what the legal documents show, but in terms of what the intent of each of the parties was, or what the resultant benefits or potential shortfalls/negative consequences may have been to anyone involved.

That's why we have courts, lawyers, and trials.

That's not to diminish what anyone is saying. But we're not going to litigate it here. Drawing any lines in the sand in a situation like this, when none of us are privy to the detailed facts, there's really no point in it. I'm not saying we can't talk about it, but first of all, if we're going to converse about it at length, someone needs to start a dedicated thread about it. Secondly, let's keep it friendly. No one here should be getting in a wad over something like this that doesn't impact us in any way personally, no matter what our opinions are.
 
I highly doubt there will be an actual money obtained in this particular action by Oher. Some of the things he asks for, like injunctions, are probably not under the jurisdiction of the Probate Court. Some of the actions he highlights could constitute a tort action, but that would be for a different court and judge to consider; Shelby County has specific Probate Court judges versus their regular Circuit Court judges. The movie allegations might even require suit be filed in California.

The request for an accounting will likely die quickly, as there doesn't seem to be anything indicating a Petition for a Fiduciary. A conservator of the person only requires providing for basic needs.

Oher didn't file this for the money, or if he thought he was, his lawyers are taking him for a money ride(and that indicates he still has money to pay 3 people hundreds per hour).

The order states that the Tuohys are only conservators of his person, not the finances, so the petition to ask for an accounting will likely not produce much. But the language is quite tedious to process, because the Tuohys also have "all powers of attorney". There can be power of attorney over finances, medical, legal, etc. If they have "all powers of attorney", I would infer that means the Tuohys do have all those powers to this day. There is no bond filed with the court either.

In the end, the court will likely only decide whether the conservatorship will continue or not. Even though it could "Grant any other relief the court considers appropriate and in the best interest of the person with a disability.", the way the pleading is written, there are no specific counts stating what violations of law occurred, something an attorney would flesh out if they were serious about that. The court will do one of four things to the petition: dismiss it, remove conservator and dissolve the conservatorship, remove the current conservator and appoint a successor, or modify the original order.

What he'll probably get is that he no longer has to get his conservators' approval to enter contracts. So, he can buy a house, open a bank account, buy a car, find another job, without them controlling that decision. Maybe he wanted to buy a house or car with his wife and title said asset together in both of their names; he asked his the Tuohys, and they refused him. Then he realized the scope of what they can do over him.

This petition is like just a warning shot, with only a small peppering of potential misconduct written out. His life story is mostly fluff and all the allegations that appear based on paperwork is old enough to be barred by statute of limitations. More damage will be done to the Tuohys in the court of public opinion than monetarily, as the representation that they adopted him is false. At the time of the court order, there were no other ongoing proceedings. At the present, the Tuohys misrepresented tot he world that adults cannot be adopted when they absolutely can in Tennessee. And implicitly, the Tuohys promised him money by saying they were adopting him....and the public would have believed that too since adoption as understood by laypeople is that someone not of biological relation to at least one parent becomes part of a family.

It is personal to me, because my grandmother was put under a guardianship by the state, and the shenanigans they did were not something I'll willing to let slide. My mother spent considerable time and money to both go through a criminal jury trial and the guardianship proceedings to get custody back. So, I have little regard for attorneys who pursue and obtain a guardianship/conservatorship over another.

And recently, I took a look at the case file, and saw that even the police was in on some of the misconduct; the county also only gave back custody after that officer retired from the force. I recently made payment to the MD State Archives for the files, they haven't given me the copies even though they sent a different file (and request) just last week.
 
Boy oh boy. Seems that Michael himself wrote in his book in 2011 that he KNEW he was under a conservatorship.

Hollywood accounting will always be evil. From what I've read, Star Wars still hasn't made a profit.
