U.S. patent office cancels Redskins trademark registration, says name is disparaging - The Washington Post

The ruling does not mean that the Redskins have to change the name of the team. It does affect whether the team and the NFL can make money from merchandising because it limits the team’s legal options when others use the logos and the name on T shirts, sweatshirts, beer glasses and license plate holders.

In addition, Native Americans have won at this stage before, in 1999. But the team and the NFL won an appeal to U.S. District Court in 2009. The court did not rule on the merits of the case, however, but threw it out, saying that the plaintiffs didn’t have standing to file it. The team is likely to make the same appeal this time. Team officials are expected to make a statement this morning.

CNN made no reference and their guest 'legal analyst' said the team has "no choice" but to change the name and this ruling means they "cannot use it in a commercial context"

which I'm pretty sure is wrong...
 
If our name is so offensive then what about the Cowboys? They are the ones that killed and took their land.

If they don't have a trademark, any one of us can make Redskins merchandise, and sell it legally. Snyder would lose a lot of money, but more importantly, so would every other owner in the league.

I agree it'll change and those will be the reasons...

But I'm genuinely curious how much that really matters. There's tons of unlicensed merchandise available for cheap and the team makes boat loads of money.

The only way I'd see it happening is if box stores rushed to stock unlicensed merchandise, which I have a hard time believing they would. Especially if the NFL was going to threaten them by denying their rights to sell licensed stuff...

All of that is to say I think there is plenty of money to continue being made... if the name changes it'll be because Snyder is a POS and for no other reason. Remember - he's the one that claims to be a 'life long fan.'

Well Snyder, time to put your money where your mouth is...
 
sooooo...let's hypothesize that the arbiters of PC thinking and control over expression win out on this. how many of you plan to go along and wear new gear? how many will stand strong and sport their Redskin gear? how many will join the chorus on the ole HTTR song and how many will abandon it for whatever PC tune is the replacement?

We'll win on appeal.

was reading about this, apparently the first case was thrown out because the people claiming to be offended were told you have waited too long and your now too old. So a new case was started by younger people, by younger I mean under 30. But if the name and logo are older than 30, how can they possible argue that they were originally done to offend those now claiming to offended. signed confused of Scotland :s
 

I do like this part:

This is not the path to diversity, compassion and multicultural understanding. Eliminating all Indian-sounding words does not honor the heritage of Native American Indians.

I usually read some commentary that follows these 'articles', surprisingly there were none posted at the time.

This morning, after reading about the trademark thing, the comments just rolled along.... most declaring a victory with the obligatory rebuttal.

The Intellihub blurb, satire and all, seems to have left the PC-crowd speechless.

Perhaps they're just stunned.
 
Oh and one more thing... just to clarify, I can call someone an idiot on this site with no consequence?

Simple question...smart assed in nature? Maybe a little, but you eliminate a forum filled with contentious issues, a certain poster disappears...a contentious issues arises, and said poster is back. There was a couple weeks of real harmony on this site. Now I see disparaging terms strewn about. What am I to think?
 
I asked this in the Redskins statement thread and I'll try here....

I don't want the name to change but say it does. If 90,000 still show up at Fed Ex in full Redskins regailia and sing "Hail to the Redskins" after every score..with it caught on live TV..then what? Will the PC minority really have done anything?
