I read this article on the guy that was killed by the train in NY recently. He was pushed down onto the tracks during a fight.

Fast Forward:

In this hypothetical, the Photographer has been arrested for failing to assist the man who was about to be hit.

As the Judge (or Jury) what do you rule?

Was he negligent and criminal for taking the time to snap a pic rather than helping?

Could he have helped at all anyway?


Could he have dropped everything, and grabbed him and pulled him out in time?

The whole situation sucks, but the photographer should not in any way ever even hypothetically face charges. Especially with how good samaritans have gotten the finger from the system in recent years.

Say hypothetically that the cameraman dropped everything and ran to help. Then, when pulling the guy off the tracks, the guy caught his pants on the edge of the platform and had his legs ripped off his body. He would then sue the photographer and win for causing him to be severely handicapped.

Good point and I so agree with how crappy things are for good samaritans so often.

I am personally torn on this one though, That shot was just too clean to have been a rush job and that tells me that he could have saved that poor guy. I also cant fathom how all the other people there allowed this to happen.
 
If they're going to prosecute the photographer, then they have a subway station full of other ppl to prosecute as well. The photographer is just extra ****ish bc he's profited off of the situation.

This is a good point that a lot of people are overlooking. The train could have been going full speed, and it could have been impossible to help. Hard to tell from a still shot.

As far as the climbing back up, the guy in 09 that jumped down to save someone said it isn't as easy as that, because apparently there is no wall under that ledge. It's essentially like falling through ice and trying to pull yourself out. It's pretty close to impossible, as I have unfortunately experienced before.
 
Yeah, I often ask myself what I would do in a similar situation. My instinct would be to capture the image, while my head would be telling me to help. Of course there are variables involved that have been mentioned....
 
Voted no, shouldn't be charged with anything.
Question: Doesn't his photography seriously assist the prosectution in this case? Have no idea but maybe the culprit wouldn't have been caught without this evidence.
 
The photographer was too far away to get there in time. There were other people much closer to the guy. Really a horrible situation.
